Med Spa Makeovers is operated by AFRO Agency, LLC, the contracting entity for all Orders placed under this brand. By accessing the Services or entering into a service agreement with us, you agree to be bound by these Terms.
1. Services
MSM provides digital marketing, website design and development, and appointment-recovery automation services to med spas and aesthetic practices. The specific scope, deliverables, fees, and timeline for each engagement are set out in a separate proposal, statement of work, or order form (an “Order”). In the event of a conflict, the signed Order controls over these Terms for that engagement.
2. Client responsibilities
You agree to provide accurate information and to supply, in a timely manner, any materials, access, and approvals reasonably required for us to deliver the Services. You are responsible for the legality of any content, claims, and offers you ask us to publish or promote.
3. Fees and payment
Fees are described in your Order. Unless stated otherwise, invoices are due within the period specified on the invoice. Late amounts may pause delivery of the Services until resolved.
4. Intellectual property
Upon full payment, you receive the rights to the final deliverables specified in your Order. AFRO Agency, LLC retains ownership of its pre-existing tools, templates, frameworks, and know-how. We may reference completed work in our portfolio unless you request otherwise in writing.
5. Third-party platforms
The Services may rely on third-party platforms (for example, advertising networks, analytics, hosting, and CRM tools). Your use of those platforms is subject to their own terms, and we are not responsible for their availability or actions.
6. Disclaimers
The Services are provided on a commercially reasonable basis. We do not guarantee specific results, rankings, appointment volumes, or revenue, as outcomes depend on factors outside our control.
7. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of the Services is limited to the fees paid for the engagement giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
8. Term and termination
Either party may terminate an engagement as set out in the applicable Order. Fees for work performed up to the termination date remain payable.

These SMS Terms describe the text-messaging program operated by Med Spa Makeovers (“MSM,” “we,” “us”), a brand of AFRO Agency, LLC. By providing your mobile phone number and opting in, you agree to these terms.
1. Program description
When you submit your phone number through our website chat widget or a form and opt in, MSM may send you text messages relating to your enquiry, such as appointment scheduling, booking confirmations, follow-ups, customer care, and account or service notifications.
2. Consent and opt-in
You opt in by submitting your mobile number through our chat widget or forms and agreeing to receive text messages. Consent to receive marketing or promotional texts is not a condition of purchasing any goods or services. Message and data rates may apply.
3. Message frequency
Message frequency varies based on your interaction with us. You may receive messages in response to your enquiries and as part of any program you opt into.
4. Opt-out and help

This Acceptable Use Policy (“AUP”) sets out the conduct and content that are not permitted when using Med Spa Makeovers’ website and services (the “Services”). It forms part of, and is governed by, our Terms of Service. By using the Services, you agree to this AUP.

Data Processing Addendum
This Data Processing Addendum (“DPA”) forms part of the agreement between AFRO Agency, LLC, operating as Med Spa Makeovers (“Processor”), and the client (“Controller”) and applies where we process personal data on the Controller’s behalf in the course of providing the Services.
1. Roles and scope
For data the Controller provides or that we process on the Controller’s instructions (for example, lead data, customer contact details, and analytics audiences), the Controller is the controller and we are the processor.
2. Processing instructions
We process personal data only on the Controller’s documented instructions, including as set out in the applicable Order, except where required by law.
3. Confidentiality
We ensure that personnel authorised to process personal data are bound by confidentiality obligations.
4. Security
We maintain appropriate technical and organisational measures designed to protect personal data against unauthorised access, loss, or disclosure.
5. Sub-processors
The Controller authorises us to engage sub-processors (for example, hosting, analytics, email, and CRM providers) provided we impose data-protection terms consistent with this DPA.
6. Data-subject requests
We assist the Controller, where reasonably possible, in responding to requests from individuals exercising their data-protection rights.
7. Personal-data breaches
We notify the Controller without undue delay after becoming aware of a personal-data breach affecting the Controller’s data.
8. International transfers
Where personal data is transferred across borders, the parties rely on an appropriate transfer mechanism as required by applicable law.
9. Deletion or return
On termination of the Services, we delete or return personal data as directed by the Controller, except where retention is required by law.
